Welcome to La Scuola’s Virtual La Dolce Vita!


We are excited about La Scuola’s online Live Auction!  Our Live Auction is a fabulous opportunity to come together, support our school and strengthen the bond of our school community! 

In addition to the Live Auction, community members will be able to support Fund-A-Need and join others in benefitting financial assistance, an important priority at our school.

Please read the following terms and conditions that apply to the Live Auction and Fund-A-Need (collectively “Auction”) and that by participating in the Auction, you are deemed to agree to.



 

AUCTION TERMS AND CONDITIONS

 


1. A listing of the Live Auction items is provided.  Each bidder should carefully review the details and restrictions on each item on which the bidder bids.  All items are sold “as is” with no warranties express or implied.

2. Each bidder must use his or her assigned bid number. 

3. The decision of the Auction Official and Auctioneer regarding the closing bid(s) and other Live Auction procedures, rules and decisions, is final. 

4. The School makes no warranties, express or implied, on any goods or services on the Live Auction items listed or sold.  Each bidder represents that he/she has made his/her own inspection of the goods. The entire risk as to quality, value and performance of each bid item is the responsibility of the bidder. 

5. Values for each Live Auction item are determined by the donor and are not warrantied by the School for tax or any other purpose.  The amount of a bidder’s contribution that may be tax deductible is limited to only the amount paid in excess of the fair market value of the benefit/item received.  The School is not responsible for any taxes found owing on any purchases. Please consult a tax professional. 

6. Travel item restrictions are specified. Dates for vacation and travel times are subject to mutual availability and agreement of the donor and bidder.  Blackout periods, expiration dates, and other restrictions may apply.  Reservations with airlines and hotels should be made as soon as possible.  Please carefully read the Live Auction item descriptions and any certificates before bidding and again when purchased. 

7. For items on the Live Auction list involving international travel, bidders should educate themselves about issues occurring in those areas as situations can be fluid and arise unexpectedly.  Bidders should consult the U.S. State Department website for country-specific information, including any travel warnings or travel advisories.  

8. Bidders understand that events beyond the donor’s and School’s control, such as force majeure including but not limited to, a natural disaster, pandemic or act of war, may prevent the bidder from taking a trip purchased on the days scheduled and reservations and airline tickets purchased or from taking the trip at all, or from receiving the benefit of other goods and services purchased, and bidder accepts this and all other risks of bidding on and purchasing any goods or services on the Live Auction items list.

9. The School has endeavored to describe the items in the list of Live Auction items correctly, obtains descriptions from the donors, and sells all items “as is.”  The School neither warrants nor represents, and is in no way responsible for, the correctness, genuineness, or authorship of the description, or the value of any item.  No statement made at the Live  Auction or elsewhere shall be deemed to be such a warranty, representation or assumption of liability.  The School is not responsible for any restrictions omitted or not otherwise indicated for any goods or services in the list of Live Auction items or purchased at the  Live Auction.

10. For items on the Live Auction list involving the use of real or personal property, the purchaser is responsible for any damage to the property caused by or resulting from the use of the property by the purchaser or the purchaser’s guests or invitees.  Unless otherwise provided in writing in the bid description or any certificate, the following conditions apply: donor is not responsible for any injury or accident to anyone that occurs during the purchaser’s use of the property; transportation to and from the property is not included in the Live Auction purchase; smoking and pets are not permitted at any real property; the purchaser is responsible for long distance telephone calls and any fax, internet or data charges; the purchaser should leave the property in the same general condition as found upon arrival.

11. For Live Auction items involving the use of a property and/or a service to be provided, absent a specific expiration date stated in the list of Live Auction items, the donor reserves the right to require the use or service to be completed by March 20, 2022.

12. The School and its agents make no representation or warranty regarding the quality or satisfaction of any items sold at the Live Auction, and it disclaims any responsibility to the donor, purchaser or user of a Live Auction item for injury or damage of any kind to property or person.

13. All items are sold at the Live Auction “as is.”  All sales are final.  There will be no refunds, exchanges or substitutions made by the donor or the School, for any reason.

14. Payment for Live Auction items and Fund-A-Need donations are due no later than March 31, 2021.  Bidders will receive statements for items bid on and purchased at the Live Auction and also for amounts for   Fund-A-Need in April 2021. 

15. By permitting the sale of the Live Auction item and by purchasing the item, respectively, the donor and the purchaser agree to the above terms and conditions.

16. Matching challenges may be offered during the Fund-A-Need portion of the Auction.  If the matching challenge(s) are met, note that one or more of these matching payments may be met by making a grant recommendation to La Scuola from a Donor-Advised Fund(DAF). All such grant recommendations must be approved by the respective sponsors of the donor-advised funds. 



Please note:


Live Auction Items: Per IRS regulations, Live Auction items cannot be paid for with Corporate Matching Gifts or by recommending a grant from a DAF because goods and/or services are received by the bidder.

Fund-A-Need Donations: Recommending a grant from a DAF may generally be used for Fund-A-Need donations. However, since certain procedures must be followed per IRS regulations, please contact your DAF and/or other advisors for the proper procedures to be followed.
